Terms of Use
These Terms of Use ("Terms") are an agreement between you and guama.dev, based in California, United States ("we," "us," or "our"), covering the Prowlogue app for Apple TV (the "App") and the Prowlogue+ subscription. By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
SECTION 16 REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION AND WAIVES CLASS ACTIONS AND JURY TRIALS, UNLESS YOU OPT OUT AS DESCRIBED THERE.
1. Eligibility
You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.
2. Your License
The App is licensed, not sold, to you. Your license is governed by Apple's Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula), which these Terms supplement. If the two conflict regarding your license to the App, Apple's agreement controls. Open-source components included in the App are licensed under their own terms, listed in Settings › About › Legal › Open Source Licenses, and nothing in these Terms limits your rights under those licenses.
3. What Prowlogue Is
Prowlogue is a player and client for media servers and services that you run or subscribe to yourself, such as a Jellyfin server, an IPTV service, or a Seerr instance. Prowlogue does not host, provide, store, index, or sell any media content, and includes no content of its own.
4. Your Content and Responsibilities
You are solely responsible for the content you access through the App, for having the legal right to access, stream, and request it, and for complying with the terms of every server and service you connect. In particular:
- The App lets you change how it identifies itself to IPTV services (its user agent). You are responsible for making sure your use of that setting complies with your provider's terms.
- When you connect your own Seerr instance with an API key, you authorize the App to act in that instance on your behalf, including creating a Seerr user linked to your media-server account.
- You are responsible for the security of your servers, accounts, credentials, and network.
5. Third-Party Services and Trademarks
Many features depend on software and services operated by you or by third parties, such as your media server, its plugins, IPTV providers, Seerr, and artwork providers. They are governed by their own terms; we do not control them and are not responsible for their content, availability, accuracy, or conduct. Prowlogue is independent and is not affiliated with or endorsed by the Jellyfin or Swiftfin projects, Seerr, or The Movie Database (TMDB). Jellyfin is a trademark of the Jellyfin project; Apple, Apple TV, and tvOS are trademarks of Apple Inc.; other names and marks belong to their owners. "Prowlogue" and its logo are our trademarks.
6. Prowlogue+ Subscription
Prowlogue+ is an optional auto-renewable subscription, offered monthly or annually, that unlocks additional features described in the App.
- Payment is charged to your Apple Account when you confirm your purchase.
- If a free trial is offered, its length is shown before you subscribe. The trial converts to a paid subscription at the price shown unless you cancel at least 24 hours before it ends. Any unused portion of a trial ends when you purchase a subscription.
- Your subscription renews automatically at the then-current price for the same period unless you cancel at least 24 hours before the current period ends. Apple will notify you of any price increase as required by its rules.
- You can manage or cancel your subscription at any time in Settings › Users & Accounts › Subscriptions on Apple TV, or in your Apple Account settings on any device. Cancellation takes effect at the end of the current period.
- Billing, refunds, and taxes are handled by Apple under Apple's terms. We cannot issue refunds directly; you may request one from Apple at reportaproblem.apple.com.
We may add, change, or remove features in Prowlogue+ or in the free version of the App. If a change materially reduces Prowlogue+ for an active subscriber, you may cancel as described above.
7. Beta Versions
The App or some of its features may be offered as a beta, including through Apple's TestFlight. Beta versions may be incomplete, contain errors, or be changed or withdrawn at any time, and are provided without any commitment of support. Apple's TestFlight terms also apply to TestFlight builds.
8. Acceptable Use
You agree not to:
- use the App to infringe anyone's intellectual property or other rights, or to access content you are not authorized to access;
- use the App in violation of any law, or of the terms of any service you connect;
- copy, modify, reverse engineer, decompile, or redistribute the App, or circumvent its subscription features, except as permitted by applicable law or by the open-source licenses described in Section 2; or
- interfere with or disrupt any server or service through the App.
9. Feedback
If you send us suggestions or feedback, we may use them freely and without obligation to you.
10. Privacy
Our Privacy Policy, available in the App under Settings › About › Legal and at prowlogue.app/privacy, explains how the App handles information.
11. Changes to the App and Termination
We may change, suspend, or discontinue the App or any feature at any time. Your rights under these Terms end automatically if you breach them. You may stop using the App at any time by deleting it; deleting the App does not cancel a subscription, which you must cancel through Apple. Sections 4, 5, and 9 through 19 survive the end of these Terms.
12. Disclaimer of Warranties
To the fullest extent permitted by law, the App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, secure, or error-free; that it will work with any particular server, plugin, service, stream, or device; or that any content will be available or accurate.
13. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, content, profits, or goodwill, arising out of or relating to the App or these Terms, even if we were advised of the possibility. Our total liability for all claims arising out of or relating to the App or these Terms is limited to the greater of the amount you paid for Prowlogue+ in the 12 months before the claim arose or US$50. These limits apply to every theory of liability and even if a remedy fails of its essential purpose.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold us harmless from any claims, damages, and expenses, including reasonable attorneys' fees, arising out of your content, your use of the App, or your violation of these Terms, of any law, or of the rights or terms of any third party.
15. Consumer Rights
Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of the above may not apply to you. Nothing in these Terms limits any rights you have as a consumer that cannot be waived or limited by contract.
16. Dispute Resolution and Arbitration
Please read this Section carefully. It affects how disputes between you and us are resolved.
- Informal resolution: before starting a proceeding, you agree to email us a description of your claim and to try in good faith to resolve it with us for 60 days.
- Binding arbitration: except as stated below, any dispute arising out of or relating to the App or these Terms will be resolved by final and binding arbitration on an individual basis, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules before a single arbitrator. The Federal Arbitration Act governs this Section. The arbitration may take place by video conference or, if in person, in the county where you live. Fees are allocated as the AAA rules provide. The arbitrator may award the same individual relief a court could, but only in favor of the individual party seeking relief and only as needed for that party's individual claim.
- Exceptions: either party may bring an individual claim in small-claims court, or seek injunctive relief in court for the infringement or misuse of intellectual property.
- Class action and jury waiver: you and we each may bring claims only individually, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. You and we each waive the right to a jury trial. If this waiver is found unenforceable for a particular claim, that claim must be severed and decided in court, and the rest of this Section still applies.
- Opt-out: you may opt out of this Section by emailing [email protected], with the subject "Arbitration Opt-Out" and your name, within 30 days after you first accept these Terms. Opting out does not affect the rest of these Terms.
- Outside the United States: if you live in the European Union, the United Kingdom, or another country whose law does not permit this Section, it does not apply to you, and you may bring claims in the courts of your country of residence.
17. Governing Law and Venue
These Terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law rules, except that mandatory consumer-protection laws of your country of residence still apply to you. Any dispute not subject to arbitration will be brought in the state or federal courts located in California, unless the law of your country of residence entitles you to sue in your local courts.
18. Apple
These Terms are between you and us, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support for it. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App; if the App fails to conform to an applicable warranty, you may notify Apple, which may refund the purchase price, if any. We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, claims that it fails to meet any legal or regulatory requirement, consumer protection claims, and claims that it infringes a third party's intellectual property. You confirm that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
19. General
These Terms, the Privacy Policy, and Apple's Licensed Application End User License Agreement are the entire agreement between you and us regarding the App. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms; we may assign them, including to an entity we form or to a successor in a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
20. Changes to These Terms
We may update these Terms from time to time. The current version, with its effective date, is always available in the App under Settings › About › Legal and at prowlogue.app/terms. If we make a material change, we will tell you in the App or its release notes before the change takes effect. By continuing to use the App after a change takes effect, you accept the updated Terms; if you do not agree, stop using the App and cancel any subscription.
